Customer Responsibilities
Site Access and Preparation
You must give us safe access and good lighting on site. Furthermore, tell us about any hazards before we arrive. This includes asbestos and any structural risks. In addition, your site must be ready before we start work. Therefore, any delays you cause may attract extra charges. As a result, please make sure your site is fully ready on the day.
Warranties
We give a 6-year workmanship warranty on all home installations. In addition, each product carries its own manufacturer warranty. Furthermore, you must make all warranty claims within 10 business days of finding a fault.
What Our Warranty Does Not Cover
However, we do not cover faults caused by:
Misuse or accidental damage
Poor or neglected maintenance
Vermin damage
Power surges
Corrosion
Rebates and VEU Program
How the VEU Program Works
The VEU program sets its own rules for rebate eligibility. Furthermore, you must give us all required documents to process your rebate. Therefore, if the government rejects your eligibility, you still pay the full contract price. As a result, do not rely on rebate savings until the government confirms your eligibility.
Force Majeure
We are not liable for delays caused by events outside our control. For example, bad weather, supply issues, or new laws can affect our schedule. Furthermore, we tell you as soon as possible if this happens. Therefore, both parties agree to work together to reschedule affected work fairly.
Default
What Happens If You Default
If you do not pay or break these Terms, we can stop all work. Furthermore, we can take back goods from your site. Moreover, we recover all costs your breach causes us. Therefore, please contact us early if you expect any payment issues.
Specifications
We provide all drawings and specs as drafts and estimates only. Furthermore, we own all rights to every spec, drawing, and document we produce. Therefore, you must keep all specs private and confidential. As a result, you may not use any spec without our written permission.
Recalls
If a product recall occurs, you must help us manage it fully. Furthermore, please act quickly and work with us throughout the process. Therefore, slow responses may extend the recall time for everyone involved.
Subcontracting
We may subcontract part or all of your job to a third party. Furthermore, we stay fully responsible for the quality of all subcontracted work. Therefore, your rights under these Terms stay fully protected at all times.
Locating Units and Registers
What Happens If You Are Not Home
If you are not home during installation, we choose the best unit location. Furthermore, structural limits may mean we cannot follow the original plan. Therefore, you pay all costs if you ask us to move an installed unit later. In addition, you must fix any affected walls, paint, or plaster. As a result, we strongly suggest you be home on installation day.
Design Conditions
We base all designs on you having proper roof and wall insulation. Furthermore, we also expect external blinds on north and west-facing glass.
Rated Design Conditions — Australian Standard 1861
| Mode | Indoor | Outdoor |
|---|---|---|
| Cooling | 27°C dry / 19°C wet | 35°C dry / 24°C wet |
| Heating | 21°C dry | 7°C dry / 6°C wet |
Therefore, tell us in writing at order time about any special site needs. In particular, include heritage overlays or access issues. As a result, we plan your job correctly from the very start.
Air Balancing
We balance all ducted outlets as well as we can. However, perfect air balance is not always possible due to your home's structure. Furthermore, we make every effort to spread airflow evenly across all rooms. Therefore, if you ask us to rebalance after installation day, we charge our standard rate plus parts.
Manufacturer's Warranty
We install goods — we do not make them. Furthermore, all goods carry the manufacturer's own warranty terms. In addition, warranty cover varies between brands and products. Therefore, we consider every job done when installation is complete. As a result, you must not hold back payment because a product needs manufacturer warranty work.
Zoned Systems
How Zoned Systems Work
A zoned ducted system cannot heat or cool your whole home at once. Therefore, you must close unused zones to reach the right temperature. Furthermore, we explain this clearly to every customer before installation begins. As a result, you fully understand how your system works before you commit.
Privacy
We collect your personal details to manage your service and warranty needs. Furthermore, we handle all personal data under the Privacy Act 1988 (Cth). Therefore, you can ask us for your personal information at any time.
Governing Law
Victorian law governs these Terms. Furthermore, both parties agree to resolve all disputes in Victorian courts. Therefore, these Terms apply fully under Victorian jurisdiction at all times.
